We have assisted tribes in developing employee handbooks, TEROs, grievance procedures, drug testing policies, sexual harassment policies and training, in addressing unionization, and in development of a full range of benefit plans for tribes and tribal businesses. The Firm's lawyers are also experienced in the application of federal employment laws such as the Occupational Safety and Health Act and the Fair Labor Standards Act and their impact on tribes and tribal organizations. The Firm has established a successful record in employment matters in tribal courts and with state and federal regulatory agencies.
We have negotiated successfully with the Department of Labor regarding its request to conduct a Fair Labor Standards Act audit on a tribal bingo facility and whether the Family Medical Leave Act applies to tribal casino employees.
We have developed and implemented comprehensive sexual harassment policies and procedures for all tribal businesses and employees. This involved several training sessions with tribal employees on appropriate conduct and implementation of the new policies.
